VOCATIONAL NURSES CHARGED WITH DUI


If you are a Vocational Nurse or a Psychiatric Technician and you have been arrested for driving under the influence of alcohol, drugs or a combination of medication and alcohol, you should expect that the Board of Registered Nurses or the Board of Vocational Nurses will be notified of your arrest within a week.  The Department of Justice for the State
of California maintains a database of fingerprints submitted through "Live Scans" and will notify regulating agencies of arrests of their licensees.

The Board of Vocational Nursing and Psychiatric Technicians (BVNPT) does not have a requirement that you self-report an arrest for Driving Under the Influence (DUI) but, your application for licensing or renewal of licensing does require disclosure of criminal convictions including DUI or Reckless driving.

VOCATIONAL NURSES & PSYCHIATRIC TECHNICIANS

Vocational Nurses are regulated by the Board of Vocational Nursing and Psychiatric Technicians. The Board of Nursing publishes all of its Disciplinary Guidelines online.

The Board of Vocational Nursing requires that any conviction for any traffic offense involving alcohol or drugs must be reported to the Board.

California Code of Regulations, Title 16, Division 25 Section 2524 (VN) & Section 2579.10 (PT) provides the disciplinary regulations for Vocational Nurses and Psychiatric Technicians.

Disciplinary Guidelines and Uniform Standards Related to Substance abuse.

In reaching a decision on a disciplinary action under the Administrative Procedure Act (Government Code section 11400 et seq.) the Board shall utilize the disciplinary guidelines entitled “Disciplinary Guidelines and Uniform Standards Related to Substance Abuse” (Rev.6/20/11), which are hereby incorporated by reference. The Uniform Standards apply to a substance abusing licensee.

(a)Subject to subsection (b), deviation from the Disciplinary Guidelines, including the standard conditions of probation, is appropriate where the Board, in its sole discretion, determines that the facts of the particular case warrant such a deviation - for example: the presence of mitigating or aggravating factors; the age of the case; evidentiary problems.

(b) If the conduct found to be a violation involves the use of drugs and/or alcohol, the licensee shall be presumed to be a substance-abusing licensee for purposes of section 315 of the Code. If the licensee does not rebut that presumption, then the Uniform Standards for a substance abusing licensee shall apply.

VOCATIONAL NURSES

Business and Professions Code § 2878.5 is the statute that regulates what is unprofessional conduct for a Vocational Nurse, it reads:


In addition to other acts constituting unprofessional conduct within the meaning of this chapter, it is unprofessional conduct for a person licensed under this chapter to do any of the following:

(a) Obtain or possess in violation of law, or prescribe, or except as directed by a licensed physician and surgeon, dentist or podiatrist administer to himself or herself or furnish or administer to another, any controlled substance as defined in Division 10 of the Health and Safety Code, or any dangerous drug as defined in Section 4022.

(b) Use any controlled substance as defined in Division 10 of the Health and Safety Code, or any dangerous drug as defined in Section 4022, or alcoholic beverages, to an extent or in a manner dangerous or injurious to himself or herself, any other person, or the public, or to the extent that the use impairs his or her ability to conduct with safety to the public the practice authorized by his or her license.

(c) Be convicted of a criminal offense involving possession of any narcotic or dangerous drug, or the prescription, consumption, or self-administration of any of the substances described in subdivisions (a) and (b) of this section, in which event the record of the conviction is conclusive evidence thereof.

PSYCHIATRIC TECHNICIANS

Business and Professions Code § 4521 regulates what is unprofessional conduct for a Psychiatric Technician. It provides:

The board may suspend or revoke a license issued under this chapter for any of the following reasons:

(a) Unprofessional conduct, which includes, but is not limited to, any of the following:

(5) Use any controlled substance as defined in Division 10 (commencing with Section 11000) of the Health and Safety Code, or any dangerous drug as defined in Section 4022, or alcoholic beverages, to an extent or in a manner dangerous or injurious to himself or herself, any other person, or the public or to the extent that the use impairs his or her ability to conduct with safety to the public the practice authorized by his or her license.

In determining whether revocation, suspension or probation should be imposed in a given disciplinary action, the following factors should be considered:

  • Nature and severity of the act(s), offense(s), or crime(s) under consideration.
  • Actual or potential harm to the public.
  • Actual or potential harm to any patient.
  • Overall disciplinary record.
  • Overall criminal actions taken by any federal, state or local agency or court.
  • Prior warnings on record or prior remediation.
  • Number and/or variety of current violations.
  • Mitigating or aggravating evidence.
  • In case of a criminal conviction, compliance with terms of sentence and/or court-ordered probation.
  • Time passed since the act(s) or offense(s) occurred.
  • If applicable, evidence of proceedings to dismiss a conviction pursuant to Penal Code section 1203.4.
  • Cooperation with the Board and other law enforcement or regulatory agencies.
  • Other rehabilitation evidence.
